How broker fees work when you're renting in New York City.
The Fairness in Apartment Rental Expenses (FARE) Act took effect on June 11, 2025. Under it, a landlord's own hired broker can no longer charge their fee to the tenant — broker fees now follow whoever hired the broker. You can still choose to hire and pay your own broker, but a landlord can no longer pass their agent's fee on to you. Landlords and their agents must also disclose all required fees clearly, in writing and in listings, before a lease is signed. The law is enforced by the NYC Department of Consumer and Worker Protection.
